Terms and Conditions

MoniDex AI ("App," "we," "us," or "our") is operated by MoniDex. These Terms and Conditions ("Terms") govern your access to and use of the MoniDex AI mobile application and related services (collectively, the "Service"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using the App, you represent and warrant that you have the legal capacity to enter into a binding agreement and are not barred from using the Service under any applicable law.
2. Account Registration and Authentication
To access certain features of the App, you must create an account by authenticating through a supported third-party provider (Google or Apple Sign-In). Account authentication is managed by Clerk, a third-party authentication service.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information during the registration process and to keep your account information up to date.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms.
3. Description of the Service
MoniDex AI is an AI-powered Pokemon Trading Card Game (TCG) card scanner and price tracker. The App allows you to:
- Scan physical Pokemon TCG cards using your device camera
- Receive AI-powered card identification and recognition
- View real-time pricing data sourced from third-party marketplaces
- View historical sales data from completed marketplace auctions
- Access card metadata including set information, rarity, and condition-based pricing
The App provides pricing information for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any pricing data displayed. Actual market prices may vary.
The App is not affiliated with, endorsed by, or sponsored by The Pokemon Company, Nintendo, TCGPlayer, eBay, or any other third-party marketplace or brand referenced within the App.
Updates. The App may be updated from time to time to add new features, fix bugs, or improve performance. Updates may be delivered automatically through the App Store. Your continued use of the App following any update constitutes your acceptance of the updated version. We are not obligated to provide any updates or to maintain backward compatibility with previous versions.
4. Subscriptions and Payments
Subscription Plans. The App offers the following subscription options:
- Monthly Subscription — Auto-renewing on a monthly basis
- Yearly Subscription — Auto-renewing on an annual basis
- Lifetime Access — A one-time, non-recurring purchase
Billing. All subscriptions and purchases are processed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscription management and billing are handled through Apple and RevenueCat.
Auto-Renewal. Monthly and Yearly subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
Managing Subscriptions. You may manage or cancel your subscription at any time through your Apple ID account settings or through the Settings section within the App. Cancellation takes effect at the end of the current billing period.
Free Features. Certain features of the App are available without a subscription, subject to usage limitations (such as a limited number of card scans). A subscription is required for unlimited access.
Refunds. Refund requests are handled by Apple in accordance with Apple's refund policies. We do not process refunds directly. To request a refund, contact Apple Support or visit reportaproblem.apple.com.
Price Changes. We reserve the right to change subscription pricing at any time. Any price changes will take effect for the next billing cycle following notice of the change.
Restore Purchases. You may restore previously purchased subscriptions on a new device using the restore purchases feature available within the App.
5. Permitted Use and Restrictions
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App for any illegal or unauthorized purpose
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Modify, adapt, translate, or create derivative works based on the App
- Remove, alter, or obscure any proprietary notices, labels, or marks on the App
- Use the App to transmit any malicious code, virus, or harmful content
- Use automated systems, bots, or scripts to access or interact with the App
- Interfere with or disrupt the integrity or performance of the App or its servers
- Attempt to gain unauthorized access to any portion of the App, other accounts, or any systems or networks connected to the App
- Use the App to scrape, harvest, or collect data for commercial purposes beyond personal use
- Misrepresent your identity or impersonate any person or entity
- Use the App in any manner that could damage, disable, overburden, or impair the Service
6. Camera and Device Permissions
The App requires access to your device camera to provide the card scanning functionality. Camera access is used solely for the purpose of capturing images of Pokemon TCG cards for identification and price lookup.
Images captured by the camera are processed by our servers for card recognition. Card images are transmitted securely to our backend infrastructure for AI analysis.
You may revoke camera permissions at any time through your device settings. Revoking camera access will disable the card scanning functionality of the App.
User Content License. By submitting card images or any other content through the App, you grant MoniDex a non-exclusive, royalty-free, worldwide, sublicensable license to use, process, store, and analyze such content solely for the purposes of providing, improving, and developing the Service. You retain all ownership rights in your original content. This license terminates when you delete your account, except as needed for backup, archival, or legal purposes.
7. Privacy and Data Collection
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
The App collects the following categories of information:
- Account information (name, email address, profile image) provided through your Google or Apple authentication
- Card images captured through the camera for AI-powered card recognition
- Subscription and purchase information managed by RevenueCat
- Feedback you voluntarily submit through the in-app feedback feature in Settings (e.g., bug reports or feature suggestions)
- Device and usage information for App functionality and improvement
We use the following third-party services that may collect and process your data in accordance with their own privacy policies:
- Clerk (clerk.com) — Authentication and identity management
- RevenueCat (revenuecat.com) — Subscription and purchase management
- Apple — App Store purchases and account management
We do not sell your personal information to third parties.
Data Retention. We retain your personal information and account data for as long as your account is active or as needed to provide you with the Service. Card images submitted for scanning are processed in real time and are not stored on our servers beyond the time necessary to complete the scan and return results, unless required for service improvement or legal compliance.
Data Deletion. You may request deletion of your account and associated personal data at any time by contacting us at jamesmontebell99@gmail.com or through the account deletion option in the App settings. Upon receiving a verified deletion request, we will process the deletion within thirty (30) days. Certain data may be retained for up to ninety (90) days in backup systems before being fully purged. We may also retain limited information as required by law, for fraud prevention, or to resolve disputes.
8. Intellectual Property
The App, including all content, features, functionality, design, text, graphics, logos, icons, and software, is the property of MoniDex and is protected by copyright, trademark, and other intellectual property laws.
Pokemon, Pokemon TCG, and all related names, characters, and imagery are trademarks and copyrights of The Pokemon Company, Nintendo, and their respective owners. MoniDex AI is an independent, unofficial tool and is not affiliated with or endorsed by these entities.
TCGPlayer and eBay are trademarks of their respective owners. Pricing data sourced from these platforms is used for informational purposes.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
9. Disclaimers
THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from the use of the App will be accurate or reliable
- Card identification by the AI system will be correct in all cases
- Pricing information will be accurate, current, or complete
- Any errors in the App will be corrected
You acknowledge that AI-powered card recognition may produce incorrect results and that pricing data is sourced from third parties and may not reflect actual market conditions. You should independently verify any information obtained through the App before making purchasing or selling decisions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONIDEX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use or inability to use the App
- Any inaccuracy in card identification or pricing data
- Any unauthorized access to or alteration of your data
- Any third-party conduct or content on the App
- Any financial decisions made based on information provided by the App
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless MoniDex and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of any third party
- Any content you submit or transmit through the App
12. Third-Party Services and Links
The App may contain links to third-party websites and services, including but not limited to TCGPlayer and eBay. These links are provided for your convenience and informational purposes only.
We do not control, endorse, or assume responsibility for any third-party websites, services, or content. Your use of third-party services is governed by the terms and policies of those third parties.
We are not responsible for any transactions you conduct with third-party merchants or marketplaces accessed through links in the App.
13. Termination
We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice.
You may terminate your account at any time by discontinuing use of the App and canceling any active subscriptions through your Apple ID account settings.
Account Deletion. You may request deletion of your account and all associated data at any time by using the account deletion feature in the App settings or by contacting us at jamesmontebell99@gmail.com. Upon receiving a verified deletion request:
- Your account will be deactivated within thirty (30) days
- Your personal data, including scan history and collection data, will be deleted from our active systems within thirty (30) days
- Residual copies in backup systems will be purged within ninety (90) days
- Data required for legal compliance, fraud prevention, or dispute resolution may be retained as permitted by applicable law
Active subscriptions are not automatically canceled upon account deletion. You must cancel any active subscriptions through your Apple ID account settings before or after requesting account deletion.
Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8, 9, 10, 11, and 15.
14. Modifications to the Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the App or by other appropriate means.
Your continued use of the App after the effective date of any modifications constitutes your acceptance of the updated Terms.
If you do not agree to the modified Terms, you must stop using the App and cancel any active subscriptions.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration or in the courts of competent jurisdiction.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding.
16. Apple App Store Terms
These Terms are between you and MoniDex only, and not with Apple Inc. ("Apple"). MoniDex, not Apple, is solely responsible for the App and its content.
Apple has no obligation to provide any maintenance or support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple shall not be responsible for the investigation, defense, settlement, or discharge of any such claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
17. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and MoniDex regarding your use of the App.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or failures of third-party services.
